Terms of service

1. Who we are

PeakReviews ("we", "us") provides software that helps businesses request, monitor and respond to Google reviews, primarily over WhatsApp. PeakReviews is operated from South Africa. By creating an account you agree to these terms on behalf of the business you represent.

2. The service

Your subscription gives you access to the PeakReviews dashboard: sending WhatsApp review requests to your own customers, monitoring reviews on your Google Business Profile, AI-drafted reply suggestions, and summary reports. Each plan includes a monthly allowance of review requests, shown on the pricing page. Unused allowance does not roll over. We may adjust plan features and allowances with reasonable notice; changes never take effect mid-billing-cycle.

3. Your responsibilities

You agree to use PeakReviews lawfully. In particular, you will:

  • only add customers who consented to hear from your business (POPIA direct marketing rules);
  • honour opt-outs. PeakReviews blocks contacts who reply STOP automatically, and you may not re-add them;
  • never solicit fake reviews, pay for reviews, or offer incentives in exchange for reviews;
  • never selectively request reviews from only happy customers ("review gating"), which breaches Google's policies;
  • keep your login details secure and your account information accurate.

You are the responsible party for the customer data you upload. We process it only on your instructions, as described in the privacy policy.

4. Billing and cancellation

  • Subscriptions are billed monthly in advance, in South African rand, through Paystack.
  • New accounts start with a 14-day free trial. No card is needed for the trial.
  • You can cancel at any time from the Billing page. Access continues until the end of the period you paid for. We do not offer partial-month refunds.
  • If a payment fails, Paystack retries it. If it keeps failing, sending pauses until payment resumes.
  • Standard WhatsApp message fees are included in your plan allowance.

5. Third-party platforms

PeakReviews is built on top of the WhatsApp Business Platform (Meta), Google services and payment infrastructure from Paystack. These platforms set their own rules, pricing and availability, which are outside our control. If a platform suspends, changes or withdraws functionality we depend on, we will do our best to adapt, but we cannot guarantee uninterrupted service. Message delivery ultimately depends on Meta and the recipient's device.

6. AI-generated content

Reply drafts are generated by AI and are suggestions only. You review, edit and approve every reply before it is published anywhere. You are responsible for the content of replies you publish.

7. Fair use and suspension

We may suspend or terminate accounts that break these terms, abuse the platform, harm other users, or put our WhatsApp or Google standing at risk (for example by messaging people without consent). Where practical we will warn you first and give you a chance to fix the issue. You can request an export of your data at any time.

8. Liability

The service is provided as-is. To the maximum extent the law allows, we are not liable for indirect or consequential damages, lost profits, or the content of reviews your customers write. Our total liability for any claim is limited to the subscription fees you paid us in the three months before the claim arose. Nothing in these terms limits liability that cannot lawfully be limited, including under the Consumer Protection Act.

9. Changes and governing law

We may update these terms as the product evolves. Material changes will be announced by email or in the dashboard at least 14 days before they take effect; continuing to use the service after that means you accept them. These terms are governed by the laws of the Republic of South Africa.
